Terms of service
1. Definitions
1.1. In these Terms:
“Afritrail” means Afritrail (Pty) Ltd.
“Consumer” has the meaning given in the Consumer Protection Act, 68 of 2008.
“Day” means a calendar day.
“Durable medium” means any format that allows you or Afritrail to store information addressed personally to you in a retrievable, unchanged form.
“Digital content” means data produced and supplied in digital form.
“Products” means the goods listed on our Site which Afritrail agrees to supply to you under these Terms.
“Services” means the services described on our Site which Afritrail or its nominated partners agree to provide to you under these Terms.

3. Applicability
3.1. These Terms apply to every offer and contract between you and Afritrail for products or services purchased via our Site.
4. Ordering & Contract Formation
4.1. When you place an order or send us emails, you consent to communicate electronically. All electronic communications satisfy the requirement for written form.
4.2. By ordering, you:
- Confirm you are at least 18 years old and legally able to contract
- Agree to these Terms
- Authorize us to verify your details before accepting any order
4.3. Your order is an offer to purchase. We accept it by sending you a dispatch confirmation (for products) or a service-start notification (for services). Only then is a binding contract formed.
4.4. Some services are provided by our partners or third-party suppliers and may be subject to their own additional terms.
4.5. All product and service descriptions on the Site form part of your contract and cannot be changed unless we agree in writing.
5. Right of Withdrawal (Consumers)
(Only applies if you qualify as a consumer.)
5.1. You have 14 days from delivery (products) or contract formation (services) to withdraw without reason.
5.2. To withdraw, notify us by email at support@afritrailshop.co.za or by post using our contact details above. A template withdrawal form is available on request.
5.3. We will refund all payments, including standard delivery costs (but not extra costs if you chose a faster delivery), within 10 days of your withdrawal.
5.4. You must return goods within 10 days, at your own cost. You are liable only for any diminished value beyond what’s necessary to inspect the items.
5.5. If services have begun with your prior consent, you lose the right of withdrawal once fully performed. If you withdraw after services start but before completion, we may charge you pro-rata for work performed.
5.6. Exceptions (no withdrawal right) include:
- Custom-made or personalised goods
- Sealed items unsealed after delivery (e.g. hygiene products, software)
- Perishable goods
- Contracts for accommodation, transport, catering or leisure activities on set dates
6. Delivery & Performance
6.1. We will deliver products or commence services without undue delay, and in any event no later than 30 days after contract formation (for consumers).
6.2. If we miss delivery or start dates, you may give us a short extra period to perform. If we still fail, you (if a consumer) may cancel and receive a full refund.
6.3. Products ship weekdays excluding South African public holidays. “Pre-order” items ship when in stock. You will receive tracking details by email.
6.4. Title and risk pass to you on delivery to you or to a designated third party (excluding the carrier). We retain ownership until final payment.
6.5. Shipping charges are displayed at checkout; expedited shipping (if chosen) is extra.
7. Price & Payment
7.1. Prices shown include VAT and any delivery charges.
7.2. In case of pricing errors, we will notify you and obtain your approval before proceeding or refund any amount charged.
7.3. Payment is accepted via the methods displayed at checkout.
8. Warranty & Liability
8.1. Products: Covered by the manufacturer’s warranty and South African consumer law.
8.2. Services: Will be provided with reasonable care and skill.
8.3. Limitations: Except for liability for death, personal injury or defective products, and except where law prohibits, Afritrail’s total liability is limited to the price you paid.
8.4. Consumers: You retain your non-excludable statutory rights under South African consumer protection law.
9. Privacy & Data Protection
9.1. We handle your personal data in accordance with our Privacy Policy and POPIA.
9.2. You agree that we may transfer data to third-party service providers (e.g. logistics, payment gateways) under appropriate confidentiality and security obligations.
10. Governing Law & Jurisdiction
10.1. South African law governs these Terms and your purchases; the CISG does not apply.
10.2. You submit to the non-exclusive jurisdiction of the South African courts.
10.3. Your statutory consumer rights under South African law remain unaffected.
